Explores dilemmas at the intersection of medicine, philosophy and law. Addressing euthanasia, abortion, and the care of groups including the elderly, the demented, and children, the author identifies a crisis both in ethics and in empowerment. This book explores the controversial dilemmas which meet at the intersection of medicine philosphy and law - questions concerning killing and not killing which are faced daily in health care. They embrace euthanasia, abortion, the care of the elderly and the demented, the care of the mentally ill children and those in a persistent vegative state. Who Owns our Bodies? identifies a crisis both in ethics and in empowerment as people face often neccessarily wretched choices. It seeks a framework of guidance for practical decision-making and focuses on two key issues. First who decides on an individual's quality of life and thus on their health care treatments? Second how can patients be empowered with a structure to enable choice, self-realization, self-reflection and self-responsibility? John Spiers with characteristic clarity and verve offers a fundamental choice between health care experienced as hierarchy and control and the alternative of choice and self-responsibilty. He argues that health care must rely on patients deciding how much power they have, not on professionals deciding how much to grant them.

De Belgische Euthanasiewet dateert van 28 mei 2002. België werd daarmee, na Nederland, het tweede land ter wereld waar euthanasie bij wet geoorloofd werd. Sinds de Euthanasiewet kunnen in België burgers onder voorwaarden maar toch in grote mate zelf hun levenseinde bepalen. Op basis van zijn zelfbeschikkingsrecht kan de burger die ondraaglijk en uitzichtloos lijdt en een ernstige en ongeneeslijke aandoening heeft, zelf bepalen of dit leven nog voldoende levenskwaliteit oplevert.De Belgische Euthanasiewet is een ‘liberale’ wet, dit wil zeggen dat zij een ruim toepassingsgebied heeft: euthanasie kan zowel voor fysiek als voor (louter) psychisch lijden, zowel voor terminale als niet-terminale patiënten, zowel voor meerderjarigen als, onder beperkte voorwaarden, voor minderjarigen en er is geen voorafgaande controle door een extern orgaan, maar een controle achteraf. De Belgische Euthanasiewet wordt door sommigen dan ook gekoesterd als een toonbeeld van persoonlijke autonomie en tegelijk menselijkheid of barmhartigheid voor degenen die ondraaglijk lijden. Anderen zien in de wet daarentegen een te ver doorgedreven zelfbeschikkingsrecht en een gebrekkige bescherming voor kwetsbare personen.Euthanasie blijft een delicaat en controversieel onderwerp. Dit hoeft niet te verbazen, nu euthanasie een breuklijn blootlegt tussen twee verschillende levensvisies, die van de absolute eerbied en de onaantastbaarheid van het leven, en die van het zelfbeschikkingsrecht van de mens.Hoe dan ook, na 20 jaar Euthanasiewet was het tijd voor een evaluatie. De Leerstoel voor Gezondheidsrecht en Gezondheidsethiek (AHLEC), verbonden aan de UAntwerpen, nam hier het voortouw en organiseerde op vrijdag 14 oktober 2022 de studienamiddag “20 jaar Euthanasiewet: tijd voor een evaluatie”. De volgende onderwerpen passeerden de revue: euthanasie bij psychiatrische patiënten, de euthanasieverklaring voor patiënten met vergevorderde dementie, euthanasie wegens voltooid leven, een nieuwe strafrechtelijke omkadering voor euthanasie, een evaluatie van de Federale Controle- en Evaluatiecommissie Euthanasie, en tot slot een blik vanuit Nederland. Dit boek bevat een bijdrage van elk van de verschillende sprekers over het thema dat zij op de studienamiddag gebracht hebben.Het boek vangt aan met een meer algemene, minder juridische bijdrage met algemene beschouwingen over de Euthanasiewet. Deze bijdrage omvat ook een lijst van bekende personen die als gevolg van euthanasie zijn overleden, een lijst van rechtszaken over euthanasie én een wereldwijd overzicht van landen waar euthanasie dan wel hulp bij zelfdoding is toegelaten. Uit dit inleidend deel blijkt ook dat de Euthanasiewet vaak wordt ingeroepen en dus blijkbaar aan een behoefte beantwoordt: nagenoeg 3.000 personen zijn in 2022 in België overleden als gevolg van euthanasie; dat zijn er acht per dag.Dit boek is een tijdsdocument dat zowel achteruit als vooruit kijkt en zich afvraagt waar de Euthanasiewet moet worden gewijzigd. Hopelijk kunnen politici, artsen, juristen, ethici, sociologen, maar ook iedere burger die zich bekommert om een menswaardig einde, uit dit boek inspiratie putten, in welke zin dan ook.

Notre société contemporaine perçoit la mort comme un échec médical et technologique.Les interrogations de plus en plus vives sur le droit à l'interruption de traitement et à une mort dans la dignité, sur l'euthanasie passive et les limites au soulagement de la douleur par la pharmacologie chez les malades en phase terminale mettent le droit et l'éthique au défi de retrouver un équilibre social entre science et culture. L'ouvrage vise à montrer comment notre société technocratique a faussé les perceptions et attitudes face à la mort, a pratiquement éliminé le contrôle de l'individu sur sa propre mort et finalement fait perdre à celle-ci son sens profond et métaphysique.Il plaide pour une réappropriation individuelle de celle-ci par le droit et l'éthique et un retour à son sens profond, c'est-à-dire au fond à sa réinsertion dans la vie de tous les jours.
